Naptown’s Next Reloaded “Tweet It or Delete It” Contest Rules

CONTEST DESCRIPTION:

The Naptown’s Next Reloaded “Tweet It or Delete It” contest (“Contest”) will begin on March 19, 2014 and end March 19, 2015 (“Contest Period”).  Submissions will be accepted exclusively online.  Once an artist receives 1,000 votes for their original clean song submission, they will be awarded the opportunity to have their song played in full during on-air personality B-Swift’s “Tweet It or Delete It” feature, during the 7pm hour of his show on week nights (Monday-Friday).  Contest entry methods and participation are more fully described below.

HOW TO ENTER:

Listeners of WHHH-FM (also “Station”) who are legal residents of the U.S. residing within the Indianapolis, IN metropolitan area who are 16 years of age or older will be able to take part in this Contest.  Participants under the age of eighteen (18) must obtain parental permission prior to entering the Contest.  To participate in the Contest, participants must do the following:

1. Listeners must upload an audio mp3 file of themselves performing a CLEAN original song for a chance to have their song aired during the “Tweet It Or Delete It” feature.The entry must be two (2) minutes or less in length.

    

2. No copyrighted music or material by other artists is permitted, and the submission of any third party copyrighted material may lead to disqualification.

    

3. Submitted entries must be “clean and radio ready”, appropriate for all audiences and must meet the below-listed Entry Requirements.

    

4. Contestants must submit their entries through the Station’s website at www.indyhiphop.com.

    

5. Upon entering the Contest website, participants are to follow the on-screen instructions, including entering their name, date of birth, address, phone number, email address, submitted entry, and any optional or additional contact information, as requested, to register for a chance to win.

    

6. Participants may not submit multiple song entries during their initial registration for this Contest.

    

7. All Internet entries must be received by 11:59pm EST on March 19, 2015, or they will be void.

    

8. Once the submitted entries have been reviewed for content by Station personnel, entries will be posted online for public voting.Graphic lyrics and any other failure to comply with these rules will disqualify an entrant from eligibility for voting.

    

9. Once an entrant’s song reaches 1,000 votes, it will be played on “Tweet It or Delete It”, and the entrant will then have another opportunity to submit an additional song.

    

10. The voting period will take place from March 19, 2014 through March 19, 2015.However, a song will not be played on-air until it has reached at least one thousand (1,000) votes.

     

11. In the event of a dispute regarding the identity of a participant’s online entry, the entry will be deemed to have been made by the authorized holder of the e-mail account at the time the entry was made.

     

12. By uploading a submission and entering this Contest, each participant represents and warrants to be bound by these Official Contest Rules, that they are authorized to and have the rights to submit the content in the entry, and that all of the below-listed requirements have been met.

Entry Requirements:

• Entries must not exceed two (2) minutes in length
• Entries may not be patently offensive, illegal, pornographic or obscene, or similarly inappropriate in the Station’s sole discretion
• Entries must not contain any profanity, obscene language, lewd or sexual content or references
• Submissions may not infringe upon any rights of any third party including without limitation, copyright, trademark and right of publicity or privacy
• Entries must be produced and solely owned by the contestant submitting the entry
• Entries must be unpublished and not have been submitted in other competitions
• Submissions must not contain: unnecessary violence, derogatory characterizations of any ethnic, racial, sexual or religious groups, humiliate other people (publicly or otherwise), or otherwise assault or threaten others
• If additional individuals are featured in the entry, each entrant warrants and represents that the entrant has obtained permission from each person who appears in the submission

ELIGIBILITY RESTRICTIONS:

1. The Contest is open only to legal residents of the United States residing within the Indianapolis, IN metropolitan area who are 16 years of age or older at the time of Contest registration.Participants under the age of eighteen (18) must obtain parental consent to participate in the Contest.

    

2. Employees of the Station, Radio One of Indiana, L.P. (“Radio One”), its subsidiaries, affiliates, general sponsors, advertisers, competitors, promotional partners, other radio stations in the Indianapolis, IN metropolitan area, and members of the immediate families or those living in the same households (whether related or not) of any of the above are NOT eligible to participate or win in this Contest.For purposes of this Contest, immediate family members mean spouses, parents, grandparents, children, and siblings and their respective spouses.

    

3. Contestants agree to abide with any applicable federal, state, local laws and regulations.

PRIZES:

1. Every entrant that receives 1,000 votes for their submitted song will have the clean version of their full song played on the “Tweet It or Delete It”, feature during the 7pm hour. The winner will not receive notification when the song will be played.There is no guarantee of rotation or future air play after the song is aired for the first time.

    

2. Prizes will be awarded only upon winner verification and final approval by the Station.

    

3. All Contest winners must sign and date official Station release and waiver forms as requested.Failure to do so will result in winner forfeiting the Prize.

    

4. If the winner is under the age of eighteen (18), all release forms and affidavits must be signed by the winner’s parent or legal guardian.

    

5. Winners must provide valid identification (i.e. via driver’s license, passport or other government-issued photo I.D.) to claim the Prize.Identification documents must match information previously provided to the Station.

EXECUTION:

1. During the Contest Period, eligible participants will be encouraged to take part in the Contest by registering online at www.indyhiphop.com.

    

2. Eligible participants must upload a CLEAN MP3 of their original song, no more than two (2) minutes in length to the Contest page. Entries must be submitted between the following dates: 12:01am EST on March 19, 2014 and 11:59pm EST on March 19, 2015.

    

3. Entries will be reviewed for content by Station personnel.Once an entry has been deemed appropriate in the Station’s sole discretion, it will be posted online for public voting.

    

4. From March 19, 2014 through March 19, 2015, listeners will be encouraged to vote for their favorite song to help an artist reach 1,000 votes.

    

5. One (1) vote per person per day.Any attempt by an entrant and/or his/her family/friends to vote more than the number of times authorized by using multiple names or email address and/or any other fraudulent mechanism, as determined by the station in its sole discretion, shall give the Station the right to disqualify the entrant in its reasonable discretion.

    

6. Becoming a winner in this Contest does NOT guarantee future radio play or exposure by the Station.

    

7. Winners will be notified by email that their song will be played on the air.At that time, the winner will be asked to submit their full clean version of the song.

    

8. Upon becoming a winner in this Contest, entrants will be asked to sign and submit a release form.

    

9. All decisions made by WHHH-FM and Radio One management or any Contest Sponsor regarding any aspect of this Contest are final.

GENERAL CONDITIONS:

1. No purchase necessary.Contest is void where prohibited.Contest is subject to all applicable federal, state, local laws and regulations.

    

2. Odds of winning depend upon the number of eligible contestants participating during the Contest Period.

    

3. By participating in the Contest, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this Contest, in any media now known or hereafter devised for advertising or promotional purposes without additional compensation, and must sign a publicity release prior to acceptance of the prize.By entering this Contest, each participant agrees to comply with these Official Contest Rules and the decisions of WHHH-FM and or Contest sponsor which shall be final and binding in all aspects relating to the Contest.

    

4. WHHH-FM and Radio One retain the right to disqualify any contestant if all Contest rules are not followed.

    

5. All Contest winners may be required to sign a liability release prior to acceptance of any prize.Pursuant to the liability release, the winner or winners will agree to hold WHHH-FM, Radio One, any other Contest parties and each of their respective affiliates, subsidiaries, agencies, officers, shareholders, directors, employees, agents and representatives of each of the foregoing, harmless against any and all claims or liability, directly or indirectly related to or arising from or in connection with Contest participation or the acceptance, possession or use / misuse of any awarded prize or any portion thereof, or participation in prize-related activities, including but not limited to any related travel.

    

6. By accepting the prize, the winner acknowledges that WHHH-FM and Radio One have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to the prize or to any portion thereof, including but not limited to its quality, mechanical condition or fitness for a particular purpose.

    

7. Any information collected by registering to enter the Contest shall be used only in a manner consistent with these Official Contest Rules.

    

8. So long as no participant is materially adversely affected, WHHH-FM reserves the right to make changes in these Contest rules, which will become effective upon being announced on the air and / or posted online.

    

9. WHHH-FM, Radio One, participating sponsors and their respective parent companies, subsidiaries, affiliates or their representatives, agents and employees are not responsible for the inability of any contestant to complete or continue an internet registration due to equipment malfunction, busy lines, inadvertent disconnections, unavailable network, server, Internet Service Provider (ISP) or other connections, communication failures or human error that may occur in the transmission, receipt or processing of entries, including any injury or damage to any computer arising from or relating to participation in this Promotion.Any use of robotic, macro, automatic, programmed or like entry methods or voting submissions will void all such entries, and may subject that entrant to disqualification.In addition, WHHH-FM, Radio One, participating sponsors and their respective parent companies, subsidiaries, affiliates or their representatives, agents and employees are not responsible for late, lost, misdirected, mutilated, illegible or incomplete contest entries.No mechanically reproduced or automated entries permitted.Entry materials/data that have been tampered with or altered are void.Once submitted, entries become the property of WHHH-FM / Radio One and will not be returned.

    

10. If for any reason, the Contest is not capable of running as planned, including without limitation, any suspected evidence of tampering or technological corruption or if any portion of the Contest is compromised by virus, bugs, worms or unauthorized human intervention, fraud, acts of God, strikes, terrorists acts, criminal acts of third parties, an insufficient number of qualified Contest entries, or any other causes beyond WPRS-FM and Radio One’s control which, in the WHHH-FM and Radio One’s sole opinion, corrupts, threatens or impairs the administration, security, fairness, integrity, or proper conduct of the Contest, WHHH-FM and Radio One reserve the right to cancel, terminate, modify or suspend the Contest at their sole discretion.

     

11. Any attempt by an entrant to deliberately undermine the legitimate operation of the Contest may be in violation of criminal and civil laws and should such an attempt be made, WHHH-FM and Radio One reserve the right to seek remedies and damages (including attorney's fees) from any such entrant to the fullest extent of the law, including criminal prosecution.
